Legal Notice and Terms of Service

1. Legal notice

In accordance with Article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), this website and the Clocked service are operated by:

2. The service

Clocked is a Discord bot that tracks the time members spend in voice channels and exposes that data via slash commands and a weekly summary. The bot's source code is open source and available at github.com/sergi-rz/clocked-bot. The hosted version offered on clocked.club is provided "as is", on a commercially reasonable best-effort basis. We do not guarantee uninterrupted availability.

3. Account

To use the hosted service you must log in with a Discord account. You are responsible for keeping your Discord credentials secure and for any activity carried out under your account.

4. Subscription and billing

Subscriptions are 30 USD per year, per Discord server, taxes included where applicable. Payments are processed by Stripe. The subscription is billed upfront and renews automatically each year unless cancelled before the renewal date through the Customer Portal accessible from your dashboard.

5. Right of withdrawal and refunds

If you are a consumer based in the European Union, you have a 14-day right of withdrawal under Royal Legislative Decree 1/2007 (Spanish consumer protection law). You can exercise it by emailing [email protected] within 14 days of your first payment, and receive a full refund. After 14 days, subscriptions are non-refundable, but you can cancel auto-renewal at any time and continue to use the service until the end of the paid period.

6. Acceptable use

You must own or have express authority from the owner to install Clocked in the Discord servers where you use it. You must not use the service to harass, surveil people without their knowledge, scrape Discord at scale, attempt to gain unauthorised access, or violate Discord's own Terms of Service or Community Guidelines.

7. Intellectual property

The Clocked bot's source code is published under the licence specified in its public repository. The "Clocked" name, logo and the contents of this website (other than user-submitted content) are owned by WEB LAB FACTORY SL. All other trademarks (Discord, Stripe, Matomo) belong to their respective owners.

8. Liability

To the maximum extent permitted by law, WEB LAB FACTORY SL is not liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the service. Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be limited or excluded under Spanish law.

9. Termination

We may suspend or terminate the service for any account that violates these terms, or that uses the service in a way that puts the platform, Discord or other users at risk. If your subscription lapses or is terminated, the bot will leave the relevant Discord server and historical voice data will be deleted after 30 days, as described in the Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the dashboard or by email to active subscribers at least 15 days before they take effect.

11. Governing law and jurisdiction

These terms are governed by Spanish law. Where the user is a consumer, any dispute will be submitted to the courts of the consumer's domicile. For business users, the parties expressly submit to the courts of Girona, Spain.
